GENERATIVE AI USE POLICY

1. INTRODUCTION

(a) This document sets out the AI Use Policy of Netarcs Ltd, company number: 04614488 with registered offices located at C/O Mericrest, 8-10 Pembroke Building Cumberland Park Scrubs Lane, London, NW10 6RE, the creators of the ‘Happimate’ (referred to below as the ‘App’, ‘Happimate’, ‘we’, ‘us’, or ‘our’).

(b) This Generative AI Use Policy applies when you use our App accessible on the iOS App Store and Google Play Store and describes acceptable use, data handling, quality control, security, and accountability measures relating to Happimate’s AI-powered features (the “AI Services”).

(c) We may update this Generative AI Use Policy from time to time by posting an updated copy on our website www.happimate.com and we encourage you to check our website regularly to ensure that you are aware of our most current Generative AI Use Policy.

(d) By downloading the App, you agree to our Mobile App Terms and Conditions and this Generative AI Use Policy, which are legally binding. Our Privacy Policy available at https://www.happimate.com/site/policies/Privacy_Policy_v1.html forms part of these Terms and governs how we collect, use, store, and protect your personal data. Please read all three documents carefully before downloading the App. Only download the App if you have read the rules and agree to them.

2. ACCEPTABLE USE

2.1 INTENDED USE

Users may use the App for the following purposes:

(a) to engage with AI-powered conversational features;

(b) to generate personalised content using AI tools, including but not limited to meditation sessions and sleep stories;

(c) to explore and use content available within the App’s library;

(d) to participate in guided sessions or shared experiences available within the App;

(e) to interact with AI features designed for general wellbeing, relaxation, creativity, and personal use.

2.2 PROHIBITED USE

Users must not use the AI Services to:

(a) engage in any illegal activity;

(b) attempt to jailbreak, exploit, or manipulate the AI systems;

(c) submit or generate abusive, threatening, violent, obscene, hateful, discriminatory, or defamatory content;

(d) submit or generate sexually explicit content or attempt to engage in sexual interactions with the AI;

(e) request or rely on the AI for medical advice, diagnosis, treatment, or emergency guidance;

(f) attempt to circumvent safety features or behavioural safeguards;

(g) upload or share personal data of another individual without their consent;

(h) promote or facilitate harm, illegal activities, or unsafe behaviour;

3. DATA POLICY

(a) Data entered into AI features may be processed and stored as part of providing the service.

(b) Happimate may access and review interactions in order to maintain, improve, and develop the AI Services.

(c) Data may be analysed in aggregated and anonymised form to improve performance, quality, and user experience.

(e) Happimate uses the OpenAI API to process your chat messages and generate AI responses. Your chat messages, conversation history, and onboarding profile data may be transmitted to OpenAI (OpenAI, L.L.C., San Francisco, USA) to deliver these features. OpenAI’s privacy policy is available at openai.com/privacy.

(f) Happimate uses the Google Cloud Speech-to-Text API to transcribe your voice recordings during voice chat sessions. Audio you record in the app may be transmitted to Google LLC for transcription. Google’s privacy policy is available at policies.google.com/privacy.

(g) We do not use your data to train third-party general AI models. Data is retained only as necessary to provide the service.

4. DISCLAIMER

(a) By using the AI Services, you acknowledge and agree that the AI Services generate content and responses based on automated systems. Outputs may be incomplete, inaccurate, or not suitable for your specific circumstances.

(b) All content provided through the AI Services is for general informational and entertainment purposes only and should not be relied upon as professional advice.

(c) The AI Services are not monitored in real time. Happimate cannot intervene in live interactions or respond to urgent situations.

(d) You are responsible for how you use the information and content generated by the App.

5. QUALITY ASSURANCE

5.1 MONITORING AND FEEDBACK

(a) Happimate continuously monitors AI system performance to:

(i) Identify and correct inaccurate, harmful or inappropriate responses;

(ii) improve relevance, quality, and usability;

(iii) Ensure compliance with our community standards, safety guidelines, and this Policy

5.2 ERROR AND SAFETY REPORTING

(a) If you encounter an issue, you can report it via the App. We take all reports seriously and will:

(i) Investigate the issue within 7 days;

(ii) provide you with a response where appropriate; and

(iii) use the feedback to update our systems and prevent similar issues in future

5.3 TESTING AND BIAS REDUCTION

(a) To improve accuracy and reduce bias, Happimate test AI systems through:

(i) Scenario-based evaluations reflecting diverse backgrounds, ages, and life experiences;

(ii) analysis of patterns in AI responses to identify and correct bias;

(iii) periodic updates to training data and safety guidelines

(b) Any testing is carried out in line with our Privacy Policy and does not use your identifiable personal data without your explicit consent. Only aggregated and anonymised data will be reviewed for bias testing.

5.4 UPDATES AND IMPROVEMENTS

(a) We may update or modify our AI systems at any time to improve performance, safety, or user experience. Significant changes will be communicated via the App or our website.
